Terms & Conditions

1. Acceptance of Terms

By creating an account or accessing SwitCity, you agree to be bound by these Terms & Conditions, our Privacy Policy, and all applicable platform policies. If you do not agree, you may not use the platform. These terms apply to all users - fans, creators, and visitors.

2. Eligibility

You must be at least 18 years of age to use SwitCity. By registering, you confirm that you meet this requirement. Users found to be under 18 will have their accounts terminated immediately. SwitCity reserves the right to request proof of age at any time.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your login credentials.
• You must not share your account with any other person.
• You must provide accurate, truthful information during registration and KYC.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorised use of your account.

4. Creator Terms

• Creators must complete KYC verification before withdrawing earnings.
• Each new creator payment is placed in a pending balance for seven calendar days from the payment date. The net amount, after applicable platform and agent fees, becomes part of the creator's available balance after that period.
• Moving money from pending to available does not send a payout. Creators must manually request and confirm each withdrawal, and may withdraw only from their available balance, subject to the current minimum, daily limits, KYC, and linked payout-account requirements.
• Refunds, chargebacks, payment reversals, fraud reviews, or other valid adjustments may reduce or cancel a pending amount. If an affected amount has already become available, the adjustment may be deducted from the creator's available balance.
• Creators own the intellectual property rights to original content they upload.
• By uploading content, creators grant SwitCity a non-exclusive licence to host, display, and distribute that content to subscribers and paying fans.
• Creators are solely responsible for ensuring their content complies with all applicable laws, including laws regarding adult content in their jurisdiction.
• Creators must not upload content featuring minors in any sexual or inappropriate context. Violation results in immediate permanent ban and referral to law enforcement.
• Creators are responsible for all tax obligations arising from their earnings.

The Upcoming Payouts screen separates available and pending balances and shows each pending payment's amount, payment source, received date, and date it is expected to become available. See the Earnings & Payouts Policy for full details.

5. Fan Terms

• Content purchased through subscriptions, PPV, or tips is for personal use only. Redistribution, screen recording for distribution, or sharing of paid content is strictly prohibited.
• Fans must not attempt to circumvent payment systems or access paid content without authorisation.
• Harassment, threatening behaviour, or abusive communication directed at creators will result in account suspension.

6. Payments & Refunds

All transactions on SwitCity - subscriptions, pay-per-view purchases, and tips - are processed by Bani and are generally non-refundable. Exceptions apply only in the case of:

• A verified technical error on SwitCity's part resulting in a duplicate charge
• A payment processed for a cancelled subscription after the cancellation was confirmed

Refund requests must be submitted within 7 days of the charge to hello@switcity.com.

7. Prohibited Conduct

You may not:

• Upload, share, or distribute illegal content of any kind
• Upload content that sexualises or exploits minors (CSAM) - zero tolerance policy
• Impersonate another person or entity
• Use automated tools (bots, scrapers) to access or extract content
• Attempt to hack, disrupt, or gain unauthorised access to the platform
• Use the platform to spam, phish, or defraud other users
• Violate any applicable local, national, or international law
• Upload, reproduce, or present content for which you do not hold the rights or proper authorisation from the rights holder

8. Content Moderation

SwitCity may review, monitor, and where necessary remove any user-posted content at any time, without prior notice, in order to enforce these Terms, our Community Guidelines, and applicable law. This includes but is not limited to content uploaded by creators, messages, profile information, and comments. Moderation may be performed by automated systems, trained staff, or a combination of both. Exercising this right does not create an obligation for SwitCity to monitor all content, nor does it make SwitCity liable for any content that is not detected or removed.

Users who believe their content was removed in error may appeal by contacting hello@switcity.com within 14 days of removal.

9. Platform Availability

SwitCity targets 99.5% uptime but does not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any feature or the platform itself with reasonable notice where practicable.

10. Termination

SwitCity may suspend or terminate your account at any time for violation of these terms, with or without prior notice. Upon termination, your access to paid content, earnings (subject to compliance review), and account data will be governed by our data retention policy.

11. Limitation of Liability

SwitCity is a platform intermediary. We are not responsible for the content uploaded by creators or the conduct of any user. To the maximum extent permitted by law, SwitCity's liability for any claim arising from use of the platform is limited to the amount you paid to SwitCity in the 3 months preceding the claim.
